Terms of Service

The rules for using NanoAPI — your account, the API, balance and billing, your content, acceptable use and your rights

2026/10/23

These Terms of Service ("Terms") are an agreement between you and Tekronix Inc, a company registered in Colorado, United States, that operates NanoAPI ("NanoAPI", "we", "us" or "our"). They apply to nanoapi.ai and everything we offer there: the NanoAPI API at https://api.nanoapi.ai/v1, the developer console, the API documentation, the online playground for our models (such as Genjutsu), share links and any related websites or apps (together, the "Service").

By creating an account or using the Service, you agree to these Terms, our Acceptable Use Policy and our Privacy Policy. If you do not agree, do not use the Service.

Key points

  • You must be at least 18 years old to use NanoAPI.
  • NanoAPI is an API platform for AI video generation. You can call it from your own software with an API key, or try the models in the online playground. Both use the same account and the same balance.
  • You pay from a prepaid balance in US dollars. Recharges are one-time payments: there is no subscription, nothing renews automatically, and your balance never expires.
  • When you create a task, its cost is calculated from the length of your source video and frozen from your balance. You are charged when the task succeeds, and nothing if it fails.
  • Your API keys can spend your balance. Keep them secret: you are responsible for everything done with them.
  • Rate limits and other API rules apply (Section 4). Do not get around them, resell access or overload the Service.
  • If you build an app on the API, you are responsible for your users and their content (Section 4.7).
  • You can get a full refund of a recharge within 7 days if you have not spent any of your balance since that recharge. See our Refund Policy.
  • You keep the rights to your inputs and, as far as the law allows, to your outputs. We do not use your content to train AI models.
  • Adult content, non-consensual use of anyone's likeness, fraud and other harmful uses are not allowed.

1. Who can use NanoAPI

You must be at least 18 years old, or the age of majority where you live if that is higher, and able to enter into a binding contract. You may not use the Service if you are barred from doing so under applicable law, or if we have previously closed your account for breaking these Terms.

If you use the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.

2. Your account

  • You sign in with a supported third-party account, such as Google. Keep that account secure: anyone who can access it can access NanoAPI as you, including your balance, your API keys and your webhook signing secret.
  • The information in your account must be accurate and kept up to date.
  • Do not share, sell or transfer your account. Do not create multiple accounts to get around limits, bans or promotional offers.
  • You are responsible for all activity under your account, including everything done with your API keys. Tell us right away at support@nanoapi.ai if you believe your account or one of your keys has been used without your permission.

3. The Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to use the Service for your personal or business purposes, including to build your own products as described in Section 4.7.

You can use the Service in two ways:

  • The API. Developers call the API from their own software with API keys created in the console. The API documentation describes the endpoints, limits and formats, and is part of how the API works under these Terms.
  • The playground. On our website you can try a model in your browser, for example Genjutsu at nanoapi.ai/genjutsu, where the person in your photos performs the moves of a source video. Playground creations can appear in Community and on share pages, as described in Section 9.

The Service gives you access to AI models, many of which are developed and operated by third parties. We may add, change or retire models and features, and change prices and limits, as described in Sections 4.9 and 5. Features marked as beta or experimental are provided for testing and may change or stop at any time.

4. Using the API

These rules apply whenever you use the API. They add to the rest of these Terms and to our Acceptable Use Policy.

4.1 API keys

  • API keys are secret credentials. Each key is shown in full only once, when you create or reset it. We store only a hashed version, so we cannot show it to you again.
  • The online playground runs your generations through the API with a key named "Playground" that we create for you and keep encrypted. It counts toward your key limit and is charged like any other key. If you delete it, a new one is created the next time you generate in the playground.
  • Keep keys on your server, in a secrets manager or environment variable. Never put them in web pages, mobile or desktop apps, browser extensions, public repositories or anywhere else others can read them.
  • You are responsible for all requests made with your keys, including the content submitted and the amounts charged to your balance, until you reset or delete the key. Charges caused by a key you exposed or shared are not refunded.
  • If a key may have been exposed, reset or delete it in the console straight away. Resetting a key makes the old one stop working immediately.
  • Your keys are for your account only. Do not share, sell or lend them, or give them to your own users.
  • We may disable a key or ask you to replace it if we believe it has been exposed or misused.

4.2 Rate limits and fair use

  • Rate limits and a limit on the number of tasks in progress apply per account and are shared by all of your keys. The current limits are listed in the rate limits documentation. Requests over a limit are rejected with 429.
  • We may change limits, set different limits for specific accounts, or temporarily lower them to protect the Service. If you need higher limits, contact us.
  • Do not get around limits, for example by using several accounts, rotating keys or coordinating requests across accounts.
  • Follow the polling guidance in the documentation, use webhooks where you can, and back off when you receive 429 or Retry-After.

4.3 Requests, retries and charges

  • A task is created, and its cost frozen, when the API accepts your request (202). Tasks cannot be cancelled once they are created.
  • If a request times out before you get a response, the task may have been created anyway. Check your tasks before sending the request again: a repeated request creates a second task, which is charged like any other.
  • Charges for tasks created by your own software, including duplicates from retries, loops or bugs in your code, are not refunded.

4.4 Source media

  • You submit images and videos as URLs. They must be publicly reachable over http(s) until the task has finished, and you must have the rights to use them as described in Section 6.5.
  • The source video is read when you create the task, to calculate its price. If it cannot be read, or is too long or too short, the request is rejected and nothing is frozen. Reference images are read when the task runs; if we cannot fetch them then, the task fails and its frozen amount is released.
  • Only submit URLs that point to media you are entitled to share with us. Do not submit URLs designed to make our systems reach private networks, internal services or systems you are not authorized to access.

4.5 Webhooks

  • If you set a webhook_url on a task, we send notifications about that task, including the full task object, to that URL. It must use https and resolve to a public address.
  • Only use endpoints that you own or control. Do not point webhooks at third-party systems, or use them to send traffic to anyone.
  • We retry undelivered notifications for a limited time, as described in the webhooks documentation, and then stop. A notification can arrive more than once. You remain responsible for checking a task's status with the API if a notification does not arrive.
  • Each webhook is signed with your account's signing secret, shown in the console. Verifying signatures is optional, but if you do not verify them, anyone who knows your webhook URL can send you fake notifications. Keep the secret confidential.

4.6 Results

  • Results are served from public URLs: anyone who has a link can open the file. Do not share result links you want to keep private.
  • Result files are not currently deleted automatically. We may introduce a retention period in the future; if we do, we will announce it in advance. Copy anything you need to keep to your own storage.

4.7 Building on the API

You may use the API to power your own app, website or service, and charge your own users for it. If you do:

  • You are responsible for your product and for everything your users submit through it. Their content must follow these Terms and our Acceptable Use Policy, and you must take reasonable steps to make sure it does, such as your own terms of use, content checks and limits on abuse.
  • Give your users a way to report content, and act promptly on reports, including reports of non-consensual use of someone's likeness. Remove content and stop users who break the rules when we ask you to.
  • Have your own terms and privacy notice that tell your users how their content and personal information are handled, including that they are processed by third-party AI providers such as NanoAPI, and obtain any consent the law requires (Section 3 of our Privacy Policy).
  • Do not offer your product to children under 13, or under the minimum age required by law where your users live.
  • Keep API keys on your servers. Your users must never receive or see them.
  • Do not suggest that NanoAPI endorses, sponsors or operates your product. You may state accurately that your product is powered by NanoAPI.
  • Do not offer the API itself as a standalone or pass-through API, proxy or reseller service, or resell or sublicense access to your account or keys, unless we agree in writing.

4.8 What you must not do with the API

  • Get around rate limits, task limits, billing, safety checks or any other technical restriction, or exploit bugs (report them to us instead).
  • Create accounts automatically, or create accounts to get around limits, suspensions or bans.
  • Run load tests, stress tests, penetration tests or vulnerability scans against the Service without our written permission. To report a security issue, see Section 11.
  • Systematically test or probe our content checks, for example by repeatedly submitting variations of blocked content.
  • Interfere with, overload or disrupt the Service or the systems of our providers.
  • Reverse engineer the Service, try to identify, extract or copy the underlying models, their weights or our internal systems, or try to reach our model providers' systems through the Service other than through the API.
  • Use the Service or its Outputs to develop or train AI models or services that compete with the Service.
  • Misrepresent who you are, or hide or falsify where your requests come from in order to break these Terms.

4.9 Changes, versioning and deprecation

  • The API version is part of the path (/v1). We may add new endpoints, fields, parameters and events at any time; these are not breaking changes, so ignore fields you do not recognize.
  • Breaking changes are released as a new version. Where we can, we will give at least 30 days' notice before we retire an API version, change a model in a way that breaks existing integrations, or stop offering a model.
  • Prices and limits can change, as described in Section 5.3. Read them from the API (GET /v1/products) rather than hard-coding them.
  • We may have to make changes with shorter notice, or none, when a model provider changes or withdraws a model, or when needed for security, legal or abuse reasons.
  • We announce changes in the API documentation, by email or in the console.

4.10 Availability and support

  • We work to keep the Service available and fast, but we do not offer a service level agreement or guarantee uptime, generation times or results. Generation times are estimates: a task that has not started within the queue time limit fails and its frozen amount is released.
  • We may suspend the API or parts of it for maintenance, security or reasons outside our control, such as an outage at a model or infrastructure provider.
  • Support is by email at support@nanoapi.ai. Include the request ID (X-Request-Id) or task ID when you report a problem.

5. Balance and payments

5.1 Your balance

  • NanoAPI works with a prepaid balance in US dollars (USD). You add money with recharges and spend it on tasks, through the API and in the playground alike.
  • Your balance never expires and cannot go below zero. We do not extend credit: when your available balance cannot cover a task, the task is not created.
  • Your balance is a prepayment for the Service and can only be spent on the Service. It does not earn interest, and it cannot be withdrawn, exchanged for cash, transferred to another account or sold, except for the refunds described in Section 5.5.
  • Part of your balance may be frozen for tasks in progress (Section 5.3). A frozen amount cannot be spent on anything else until its task ends.
  • We may correct your balance with an adjustment, for example to fix an error, to credit you after a support review or after a refund or chargeback. Adjustments appear in your billing history in the console.

5.2 Recharges

Each recharge is a one-time payment, and its full amount is added to your balance: a USD 50 recharge adds USD 50. Some recharges include a bonus, shown on our pricing page before you pay; for example, a USD 500 recharge adds USD 525. Bonus credit is used like the rest of your balance, but it has no cash value and is not refundable. The recharge amounts you can choose are shown on the pricing page before you pay. Promotion codes are not accepted. There is no subscription and no automatic renewal: we never charge you again unless you recharge again.

We may change the recharge amounts we offer. Changes apply only to later recharges and do not affect the balance you already have.

5.3 How tasks are charged

  • Tasks are charged per second of source video at the per-second price for the resolution you chose. Current prices are on our pricing page and returned by GET /v1/products. A price change applies only to tasks created after it.
  • When you create a task, we read the source video and freeze an amount of your available balance: the billed seconds of the source video × the per-second price × the number of outputs (currently always 1). How billed seconds are rounded is described in the model's pricing documentation. Source videos can be at most 30 seconds long.
  • When the task succeeds, you are charged for what was used, normally the frozen amount. The charge is never more than the frozen amount, and anything left over is released to your available balance.
  • The price shown before you submit, for example on the Generate button in the playground, is an estimate. The amount frozen when the task is created is what counts. Whether your available balance is enough is decided when the task is created; if it is not, the task is not created.
  • When a task fails, including when it has not started within 30 minutes of being queued or when its inputs are rejected by our content checks, the full frozen amount is released and you are not charged.
  • A successful task is charged even if you are not happy with the result. If a result is broken, for example an empty or corrupted file, contact support (see our Refund Policy).
  • Results withheld by our safety checks in the playground are covered in Section 8.

5.4 Payments

Payments are processed by Dodo Payments, which acts as the merchant of record for your purchase: it handles the payment, issues your receipt and calculates and collects any sales tax or VAT. The price shown includes any such tax, and the full face value is added to your balance. Your purchase is also subject to Dodo Payments' terms. We do not receive or store your full card number.

If a payment is reversed, refunded or charged back, the matching amount is removed from your balance.

5.5 Refunds

  • 7-day refund on recharges. If you request a refund within 7 days of a recharge and you have not spent any of your balance since that recharge, we will refund that recharge in full. Spending includes tasks created through the API. Details are in our Refund Policy.
  • Otherwise, payments are non-refundable, except where the law requires a refund.
  • If you are a consumer in the EU, EEA or UK, you may withdraw from a recharge within 14 days. When you start spending your balance, you ask us to begin performance right away and you acknowledge that you lose the right of withdrawal for the amount you have spent.
  • Refunds go back to the original payment method, and the refunded amount is removed from your balance.
  • If you dispute a charge with your bank without contacting us first, we may suspend your account while the dispute is open. We may refuse refunds where we see abuse of this policy.

6. Your content

6.1 Inputs and outputs

"Inputs" are the prompts, images, videos and other material you submit, through the API (including media you submit by URL and the metadata you attach) or in the playground. "Outputs" are the videos and other results the Service generates for you. Together they are "Your Content".

6.2 Ownership

You keep all rights you have in your Inputs. As between you and NanoAPI, and to the extent permitted by law, you own the Outputs generated for you and may use them for any lawful purpose, including commercial use, subject to these Terms and to the usage policies of the model providers involved. We do not claim ownership of Your Content.

AI models can produce the same or similar Outputs for other people, so your Outputs may not be unique. Whether AI-generated content can be protected by copyright depends on the law where you are, and we cannot guarantee that it can.

6.3 The permission you give us

You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display Your Content only as needed to operate and provide the Service to you. This includes fetching your media, sending your Inputs to the model providers that generate your Outputs, running safety checks, keeping your task and creation history, delivering results and webhooks, and, for public playground creations, showing them together with the Inputs used to make them in Community and on share pages (Section 9). This license ends when Your Content is deleted from the Service, except for copies we must keep for legal reasons and copies in backups that are deleted on a regular cycle.

6.4 We do not train on your content

We do not use your Inputs or Outputs to train AI models. The model providers that generate your Outputs process your Inputs to produce the result you asked for, under their own terms.

6.5 Your responsibilities

You are responsible for Your Content and for how you use it, including content submitted by your own users through your product. By submitting an Input, you confirm that:

  • you created it, or you have all rights and permissions needed to use it with the Service;
  • every person who can be recognized in it has agreed to the use of their face, body, voice and likeness in this way; and
  • using it, and the Outputs created from it, does not break these Terms or any law, or infringe anyone's rights.

Do not include sensitive personal information, such as health, financial or identity documents, in your Inputs, and do not put personal information in metadata. Keep your own copies of anything important.

7. Acceptable use

You must follow our Acceptable Use Policy. In short, you must not use the Service to create, upload or share content that:

  • is sexually explicit or pornographic, shows nudity or sexualizes anyone. NanoAPI does not allow adult content;
  • involves a minor in any sexual, abusive or exploitative way. We report such content to the relevant authorities;
  • uses a real person's face, body or voice without their consent, including face swaps, deepfakes and intimate imagery, or impersonates someone;
  • is used for fraud or deception, such as scams, fake evidence, election misinformation, defamation, or getting past identity verification or other biometric checks;
  • harasses, bullies or threatens anyone, or promotes violence, terrorism, self-harm or hatred against people because of who they are;
  • infringes intellectual property, privacy or publicity rights; or
  • is otherwise unlawful or promotes illegal activity.

You must also not scrape the Service, access it by automated means other than the API, or remove or alter any label, watermark or provenance information that we or a model provider add to Outputs. Where the law or the platform you publish on requires it, label AI-generated content as such. The API rules in Section 4.8 also apply.

8. Moderation and enforcement

We use automated and manual checks to keep the Service safe. Inputs may be rejected by our generation backend, both through the API and in the playground: the task then fails with the reason content_policy, and its frozen amount is released in full. In the playground, we also check prompts and media before a task is submitted, and results before they are shown. Our Acceptable Use Policy describes these checks.

If a finished result in the playground is withheld by our safety checks, it is not delivered, and the amount charged for it is not returned automatically. If you believe it was withheld by mistake, contact support@nanoapi.ai: we will review it and credit your balance where appropriate.

We may block a task, remove or disable content, disable API keys, limit features (including API access or rate limits), or suspend or close accounts that we reasonably believe break these Terms or the law, or put other people or the Service at risk. Amounts charged for content that breaks these Terms are not returned.

To report abuse, including content that uses your likeness without consent, use the Report link on the creation in Community or on its share page, or email support@nanoapi.ai. Tell us which content it is (for content made through the API, the result link or task ID) and why you are reporting it. If it shows you or someone you represent without consent, we will remove it or have it removed. We act on reports of non-consensual intimate imagery and of content involving minors first. We may share information with law enforcement or other authorities when the law requires it, or when we believe it is necessary to protect someone's safety or rights.

9. Public creations, share links and other people's content

Creations you make in the playground before your first recharge are public. They appear in Community on the playground page and on a share page, together with the source video, reference images and prompt used to make them, and other users can use them as a starting point for their own creations. After any recharge, new creations are private by default, and you can switch any of your creations between public and private at any time. Making a creation private removes it from Community and turns off its share link. You can also delete a creation to remove it completely.

API tasks never appear in Community, but their results are served from public URLs, as described in Section 4.6.

We are not responsible for content created or shared by other users or third parties. If you believe content on the Service infringes your rights, you can ask us to remove it with the Report link on the creation or by emailing support@nanoapi.ai.

10. Third-party models and services

Many of the AI models and safety checks behind the Service are developed by third parties and run through our infrastructure partners. Their availability, behavior and pricing may change outside our control, and they may apply their own content filters. When you use their models through the Service, you must also follow the usage policies of their providers.

Signing in with Google, paying through Dodo Payments and other third-party services are governed by those providers' own terms and privacy policies. Links to third-party websites are provided for convenience, and we are not responsible for their content.

11. Our intellectual property, feedback and security reports

The Service, including its software, API, documentation, design, text and graphics and the NanoAPI name and logo, belongs to NanoAPI or its licensors and is protected by intellectual property laws. These Terms do not give you any right to use our brand, except to state accurately that your product is powered by NanoAPI. If you send us feedback or suggestions, we may use them without any obligation to you.

If you find a security vulnerability, email support@nanoapi.ai with the details and give us reasonable time to fix it before disclosing it. Do not access other people's data, degrade the Service or keep testing beyond what is needed to show the issue.

If you believe content on the Service infringes your copyright, email support@nanoapi.ai with a link to the content and a description of your work, and we will review it. We may close the accounts of users who repeatedly infringe the rights of others.

12. Disclaimers

The Service, the API and all Outputs are provided "as is" and "as available". AI models can produce results that are inaccurate, unexpected, offensive or similar to existing works, and Outputs are not professional advice. You are responsible for reviewing Outputs before you use or publish them. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted, error-free, secure or always available, or that webhooks will always be delivered. Some places do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, NanoAPI will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, data or goodwill, arising from or related to the Service or these Terms, including losses caused by downtime, delays, failed tasks or undelivered webhooks.

Our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 6 months before the event giving rise to the claim and (b) USD 100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless NanoAPI and its team from any claims, losses and expenses, including reasonable legal fees, arising from Your Content, your use of the Service (including use made with your API keys), any product you build on the API and its users, your breach of these Terms, or your violation of any law or anyone else's rights.

15. Suspension and termination

You can stop using the Service at any time. To delete your account, email support@nanoapi.ai from the email address on your account.

We may suspend or close your account, or limit or revoke API access, if you break these Terms, if we must do so by law, if your use creates risk for us, our providers or others, or if payment is reversed. While your account is suspended, the API rejects your requests. Where reasonable, we will tell you first. If we close your account because you broke these Terms, your remaining balance is forfeited. If we stop offering the Service for reasons other than your breach, we will refund your remaining balance.

Sections that by their nature should continue after termination, including Sections 6.2, 12, 13, 14, 15 and 16, will continue to apply.

16. Governing law and disputes

If you have a problem with the Service, please contact us first at support@nanoapi.ai. Most issues can be resolved quickly this way, and we will try in good faith to resolve any dispute informally within 30 days.

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules, and disputes that cannot be resolved informally will be decided by the state or federal courts located in Denver, Colorado. If you are a consumer, nothing in these Terms takes away the protections that the mandatory laws of your country of residence give you, including your right to bring a claim in the courts where you live.

17. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in the Service before it takes effect. The date at the top of this page shows when these Terms were last updated. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, stop using the Service.

18. General

  • These Terms, together with our Acceptable Use Policy, Privacy Policy, Refund Policy and Cookie Policy, are the entire agreement between you and us about the Service.
  • If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a right, we do not waive it.
  • You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or reorganization.
  • We are not responsible for delays or failures caused by events outside our reasonable control, including outages at our model, infrastructure or payment providers.
  • We may send you notices by email, in the console or in the documentation.
  • These Terms may be provided in more than one language. If versions conflict, the English version prevails, unless the law requires otherwise.
